General Terms and Conditions (GTC) of JAKU. Matcha

1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers residing in Switzerland (hereinafter "customer").

A consumer is defined as a natural person who maintains business relations with JAKU. Matcha that cannot be attributed to their commercial or independent professional activity. Orders in quantities that are not usual for households can be rejected without justification.

JAKU. Matcha reserves the right to change these terms and conditions at any time. The version of these terms and conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order. Customer conditions that conflict with or deviate from these terms and conditions will not be recognized.

2. Information on this website

JAKU. Matcha contains information about products and services. Price and product range changes as well as technical changes are reserved. All information on www.jakumatcha.ch (product descriptions, images, illustrations, films, dimensions, weights, technical specifications and other information) are for illustration purposes and are to be understood as approximate values and are non-binding. In particular, they do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. JAKU. Matcha endeavors to provide all information and details on this website correctly, completely, up-to-date and clearly arranged, but JAKU. Matcha cannot provide any guarantee for this, either expressly or implicitly.

All offers on this website are subject to change and are not to be understood as binding offers.

JAKU. Matcha cannot guarantee that the products listed are available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and can change at any time and without notice.

3. Prices

The sales prices indicated on JAKU. Matcha represent final prices. The prices are net and in Swiss francs (CHF).

Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints remain reserved; in particular, JAKU. Matcha may make price changes at any time and without prior notice.

4. Conclusion of contract

The products and prices on this website are non-binding offers.

By placing an order via this website, including acceptance of these terms and conditions, the customer makes a legally binding offer to conclude a contract. JAKU. Matcha then sends an automatic order confirmation by email, which confirms that JAKU. Matcha has received the customer's offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as JAKU. Matcha sends a declaration of acceptance by email, confirming the dispatch of the ordered products or services.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, JAKU. Matcha is entitled not to accept or execute the order or to only accept it in part. In such a case, JAKU. Matcha will inform the customer by email. If JAKU. Matcha has already received the customer's payment, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay.

5. Payment options and retention of title

The customer has access to the payment options specified during the ordering process.

JAKU. Matcha reserves the right to exclude customers from certain payment options or to insist on payment in advance without giving reasons.

The products delivered to the customer remain the property of JAKU. Matcha until full payment has been made.

6. Delivery, Inspection and Notification of Defects

Deliveries are made by Swiss Post or by bike courier to the address supplied by the customer. Any lead times stated in the order confirmation are indicative and non-binding; JAKU. Matcha may ship partial orders, charging postage only once per order.

The customer must examine the goods immediately upon receipt as required by Art. 201 Swiss Code of Obligations (OR).

  • Transport damage or obvious defects must be reported to JAKU. Matcha within 48 hours of delivery, including photo evidence.
  • Hidden defects must be reported as soon as they are discovered, but no later than two months after delivery.

If a parcel is undeliverable or refused, JAKU. Matcha may cancel the contract after one written reminder and invoice the customer for additional costs incurred (return postage, handling).

7. Returns and Replacements (Food Products)

Because tea powder is a perishable food, all sales are final once dispatched. There is no general right of withdrawal or return under Swiss distance-selling law.

JAKU. Matcha accepts returns only when:

  1. the item was delivered damaged in transit,
  2. the item is defective within the meaning of Art. 197 ff. OR, or
  3. the wrong product was supplied.

The customer must notify JAKU. Matcha of the issue within 48 hours of delivery (see § 6). Upon timely, documented notification, JAKU. Matcha will, at its discretion:

  • replace the item free of charge, or
  • issue a refund or store credit for the purchase price of the affected goods.

Return shipping for approved claims is covered by JAKU. Matcha; unapproved returns will be refused and returned at the sender’s expense.

Statutory warranty rights under Art. 197 ff. OR remain otherwise unaffected.

8. Return conditions

The customer has the right to return the goods within 14 days of receipt without giving any reason. To save time, we recommend placing a new order directly when making an exchange. Return the original item and re-order the desired item. The refund for the returned item will be made within 5 working days of receipt and inspection of the return. The return shipping costs are to be borne by the customer unless the item is defective or incorrectly delivered.

9. Warranty

JAKU. Matcha endeavours to deliver goods of impeccable quality. In the case of defects reported in a timely manner, JAKU. Matcha guarantees that the item purchased by the customer is free of defects and functional during the statutory warranty period of usually two years from the delivery date. It is at JAKU. Matcha's discretion to provide the guarantee through free repair, equivalent replacement or by refunding the purchase price. Other warranty rights are excluded.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances.

StyleBand is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties who are not owned by StyleBand.

10. Liability

JAKU. Matcha excludes all liability, regardless of its legal basis, as well as claims for damages against JAKU. Matcha and against any auxiliary persons and vicarious agents. In particular, JAKU. Matcha is not liable for indirect damage and consequential damage, lost profits or other personal injury, property damage or purely financial loss suffered by the customer. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.

JAKU. Matcha uses hyperlinks only to simplify the customer's access to other web offerings. JAKU. Matcha cannot know the content of these web offerings in detail, nor can it accept liability or other responsibility for the content of these websites.

11. Data protection

JAKU. Matcha may process and use the data recorded during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

12. Partial invalidity

Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

13. Further provisions

JAKU. Matcha expressly reserves the right to change these Terms and Conditions at any time and to put them into effect without notice.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is the location/headquarters of JAKU. Matcha or the place of residence of the consumer.
